Where Reduced Hours Are Involved
On the other hand, where the employee is on a graduated return to work and working less than full time hours, it is to his or her advantage to be paid full salary for the public holiday, which would otherwise not be paid.
Example |
An employee is working 5 hours per day, with a reduced NWE of $400 (or $80 per day). A public holiday paid at full salary is $100. |
Day 1 = $80 |
Day 2 = $80 |
Day 3 = $100 (holiday) |
Day 4 = $80 |
Day 5 = $80 |
If a public holiday falls within the period the employee is working a 5 hour day, full salary for the holiday will mean that the employee is paid an extra $20 for that week. |
In this regard, a lesser payment, aligned with the graduated return to work entitlement, should be paid.
