DSS Definition Of 'Compensation'

For DSS purposes, a payment of compensation includes payment:

  • by way of damages;

  • under a scheme of insurance or compensation provided for by a law of the Commonwealth, a State or Territory (this includes Comcare); and

  • any other payment, such as voluntary or ex gratia payment, in lieu of compensation.

Compensation relates to loss of earnings only and must be repaid by either:

  • the beneficiary;

  • insurance company; or

  • other person liable to pay compensation (Comcare).
