Other circumstances
Procedures used in the above examples will not always apply, particularly where:
-
a lesser degree of dependency is claimed; or
-
someone else is contributing to the support of the dependant.
|
Example |
|
The deceased employee and his spouse were divorced. The spouse (who does not qualify as a dependant) has custody of the child of that marriage and received maintenance in respect of that child. |
|
Following remarriage, the spouse's current husband contributes to the child's upkeep. |
|
The child was not wholly dependent on her father at the date of death, but could be considered mainly dependent because of the maintenance payments. |
In such cases, 'C' of the calculation will need to vary to take into account whatever expected period of receipt of payments from the deceased employee is applicable.
