Other circumstances

Procedures used in the above examples will not always apply, particularly where:

  • a lesser degree of dependency is claimed; or

  • someone else is contributing to the support of the dependant.

Example

The deceased employee and his spouse were divorced.  The spouse (who does not qualify as a dependant) has custody of the child of that marriage and received maintenance in respect of that child.

Following remarriage, the spouse's current husband contributes to the child's upkeep.

The child was not wholly dependent on her father at the date of death, but could be considered mainly dependent because of the maintenance payments.

In such cases, 'C' of the calculation will need to vary to take into account whatever expected period of receipt of payments from the deceased employee is applicable.
