Section 111 And Deceased Dependants

Section 111 of the Act provides for rare instances where a deceased employee's dependant also dies prior to receiving compensation.

Subsection 111(4) states that where a claimant dies intestate his or her compensation entitlement is paid to the Commonwealth.

It states, in part:

“... where a determination is made that an amount of compensation is payable under this Act to a person and the person dies before the amount is paid, the amount forms part of the estate of the person.” [section 111 (1)]
