INDEXATION UNDER SECTION 13 – EFFECTIVE FROM AND INCLUDING 1 JULY 2002

Purpose

1.The purpose of the MCRI is to advise Delegates of changes in the statutory benefits rates of compensation payable under the SRC Act.  Please note that the increased compensation rates will only be effective from and including 1 July 2002.

Background

2.Section 13 of the Act provides for indexation to be applied to relevant amounts specified in subsection 17(3), 17(4), 17(5), 18(2), 19(7), 19(8), 19(9), 24(9), 27(2), 29(1), 29(3), 30(1) and 137(1) on 1 July each year.  The indexation is based on variations in the Consumer Price Index for the previous December quarter.  The relevant change for the December quarter 2001 as published by the Australian Bureau of Statistics, reflected an increase of 3.1 per cent in the All Groups Consumer Price Index.

Rate payable per kilometre in claims for travelling expenses to obtain medical treatment – sub-section 16(6) of the SRC Act.

Jurisdictional Policy Advice Number 2002/01 was recently received from Comcare.  The rate of compensation payable in accordance with sub-section 16(6) of the SRC Act in cases where a claimant seeks compensation for the cost of travelling (at least 50 km return) to obtain medical treatment for which the Department of Defence is liable to pay compensation will remain at 42 cents per kilometre from 1 July 2002.

Amendment Action

4.Remove MCRI 2 (Amendment 7) and replace with MCRI 2 (Amendment 8).
