Relevance of this question
This question is asking whether the condition which is the subject of the client's claim has resulted in death, as required by s 14(1), so that the investigation of initial liability is properly focussed. Section 14(1) states:
14(1)Subject to this Part, Comcare is liable to pay compensation in accordance with this Act in respect of an injury suffered by an employee if the injury results in death, incapacity for work, or impairment.
At this stage, the assessor is NOT being asked to assess the validity of the death claim, they are being asked to determine whether the disease (or aggravation) has resulted in the client's death.
Note that it is possible that the claim may be based on more than one of the listed outcomes, eg. the disease may have resulted in both incapacity and impairment, or there may have been a period of incapacity before the client's death.
