Relevance of this question
This question is testing whether a Reservist who is in receipt of Commonwealth superannuation is covered by the superannuation rules (ss 20, 21 & 21A). The superannuation rules provide that receipt of Commonwealth superannuation may, in certain circumstances, lead to a reduction of weekly incapacity compensation payments.
Three of the relevant circumstances are that:
- the client retired from Commonwealth employment after 1 December 1988;
- the retirement occurred as a result of the compensable injury; and
- the client received Commonwealth superannuation as a result of the retirement.
