Undergoing a rehabilitation program
Section 6(1)(b)(vii)(C) and (viii) extends SRC Act coverage in the case where a client is travelling to, or is at, a place for the purpose of “undergoing a rehabilitation program provided under this Act”. The following elements must be present:
- there must be a rehabilitation program approved in relation to the client;
- the purpose of attending the place must have been to undergo a rehabilitation activity in accordance with the approved program.
Note that it is not sufficient for the client to be undertaking an activity which they consider is rehabilitative in its effect; the activity must be part of an approved rehabilitation program.
