Policy basis of s 19(3)
The purpose of s 19(3) is to give both the employer and the incapacitated client financial incentive for the client's return to work:
- the more time a client works, the greater the % of NWE is payable to them (in combined compensation and earnings);
- for the employer, the more time a client works, the less the compensation cost (ie. the premium cost) and the employer achieves greater productivity from the total amount paid.
