Establishing a s 7(3) claim

The following elements must all be satisfied if the answer “YES” is to be given in response to this question:

  • the employee suffers an aggravation of a disease;
  • the employee is engaged in employment duties of a particular type with the Commonwealth or a licensed corporation;
  • the engagement commenced at any time before the aggravation first became apparent;
  • co-workers engaged in similar duties who also suffer from the disease have a significantly higher incidence of aggravation of that disease than co-workers suffering from the disease who are engaged in different duties in the employee's ordinary workplace.
