Receiving a payment of compensation
Section 6(1)(b)(vii)(D) and (viii) requires an injury to be treated as having arisen out of, or in the course of, employment if it is sustained while the client is travelling to, or is at, a place for the purpose of receiving a payment of compensation under the Act.
Withdrawal from an automatic teller
A payment of compensation is received as soon as it is paid by the Department to the client, ie:
- if paid in cash, when the money is handed to the client;
- if paid by way of direct deposit, when the money is credited to the client's account.
Accordingly, a client is not covered by this provision when they travel to, or are at, an automatic teller for the purpose of withdrawing their compensation entitlement. At this point the client is withdrawing funds for spending, not receiving a payment of compensation.
