After the first 45 weeks of incapacity, and if the client is not engaged in actual employment during the week, s 19(6) of the SRC Act provides that, if weekly incapacity compensation calculated under s 19(3)(a) is less than an amount of “minimum earnings” set by s 19, an increased rate of compensation is paid.
Section 19(7)(a) specifies the “minimum earnings” amount for a client, and this amount is increased where there are prescribed persons (s 19(8)) or prescribed children (s 19(9)) who are wholly or mainly dependent on the client.
