Dependent Prescribed Children
The number of prescribed children wholly or mainly dependent on the client is relevant to s 19(9) which provides that the “minimum earnings” for incapacity compensation purposes is to be increased by a statutory amount ($39.70 from 1 July 2002) for each such prescribed child. There is no limit to the number of prescribed children.
The minimum amount only applies after the first 45 weeks of incapacity and if the client has no actual hours of employment during the week.
