Withdrawal of Claims

As a result of the MCRS “No Surprises” policy, clients may become aware of a forthcoming adverse determination of their claim for compensation and may choose to withdraw their claim before the adverse determination becomes a reality.

If a client requests, in writing, that their claim be withdrawn, MCRS policy is to:

  1. cease all investigation into the claim;
  2. write to the client advising that the claim has been withdrawn; and
  3. put the file away after completing a withdrawal determination in Defcare.

However, if a Determination on the claim has already been made when the request for withdrawal is received, the claim cannot be withdrawn.
