AMENDMENTS TO DEPARTMENTAL INSTRUCTION B64/95 - "ADJUSTMENT OF ARREARS PAYABLE - GRANT/INCREASE OF DISABILITY PENSION/WAR WIDOW(ER)S PENSION"

INTRODUCTION

The purpose of this instruction is to advise staff of an amendment to Departmental Instruction  No B64/95 - "Adjustment of Arrears Payable - Grant/Increase of Disability Pension/War Widow(er)s Pension".

AMENDMENT

2.Please ensure that paragraph 13 is amended to read as follows:

"The new provisions will enable the recovery of a partner's 'overpaid' RA from the veteran's arrears, where RA was paid as a component of ISS.  In all other circumstances where the RA has been paid to the partner (eg service pension), and the only cause of the 'overpaid' RA is the retrospective grant/increase of DP to the veteran, there is no recoverable overpayment."
