26.3.2 Blood alcohol level of 0.05
The Safety, Rehabilitation and Compensation Commission has made a policy decision that, where an actual blood alcohol level reading is available, (most likely i — n motor vehicle accident claims), the level of 0.05 (0.05g of alcohol for each 100ml of blood) is a strong indicator of being 'under the influence ' and should be applied as the standard for determining whether the exclusion in S4(13) applies.
