8.1.5 Coverage of miscellaneous Defence associates - S5(6A)

Section 5(6A) provides that the categories of person listed under that subsection may be covered under SRCA but that coverage first requires a Declaration by the Minister to have effect in relation to either individual or organisation.  Such a Declaration was notified in the Government Gazette of 3 October 2001 and provided for the class of persons mentioned in column 1 of the following Schedule to be taken as persons employed by the Commonwealth where performing the class of acts mentioned in column 2 of the Schedule opposite the class of persons in column 1.

Persons who hold honorary rank in the Australian Defence Force

Acts performed in connection with the activities of the Australian Defence Force

Accredited representatives of approved philanthropic organisations serving in the Australian Defence Force as described in Defence Instructions (General) as follows:

  1. Australian Red Cross Society (ARCS) (Field Force);
  2. Campaigners for Christ – Everyman's Welfare Service;
  3. The Salvation Army – Red Shield Defence Services;
  4. Young Men's Christian Association – Defence Forces Division;
  5. Young Women's Christian Association – Defence Forces Division;  and
  6. The Returned and Services League of Australia – Australian Forces overseas Fund (RSL-AFOF)

 

Acts performed in connection with the activities of the Australian Defence Force

Persons who are on discharge resettlement training under an arrangement made by the Australian Defence Force

Acts performed in connection with discharge resettlement training under an arrangement approved by the Australian Defence Force

 

However, before accepting liability for any claim affected by this Declaration, clarification from the Liability and Service Eligibility Section (email: L.and.SE.Policy@dva.gov.au) about the current validity of the person's coverage for SRCA purposes should be obtained.  Claims relating to subsection 5(6A) are expected to be rare.
